Accidents happen only too frequently. If you have been injured within the last three years and it was caused through someone else's fault— whether an individual, an employer, or a Public Authority— you can claim compensation. This will include claims for your injuries, financial losses, including future losses, if, for example, you cannot go back to work.

Can I get Legal Aid
for this?

Unfortunately Legal Aid has been stopped for these cases. Now you have to claim using a “Conditional Fee Agreement”, generally known as “No Win No Fee”. Here a solicitor takes a risk of winning or losing and charges an additional fee for taking that risk. This is called a “Success Fee”. In most cases these costs are paid by the other side.

Do I need a
specialist solicitor?

Yes. You need someone who knows the law thoroughly, who knows how the system works, who can deal with insurers, who knows what steps are needed and knows exactly what you may be entitled to claim.

How long will it take?

How long is a ball of string? If the case is simple and straightforward, it could be resolved in six to twelve months. If not, it could take one to three years, or more. It all depends on the facts and the extent of the injuries.

Who pays?

The loser! So if you win you get most, if not all, your costs paid by your opponent (or rather his insurers). Except in some limited circumstances, win or lose, you do not pay our fees.
